NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

The Ella Run Monthly Leaderboard Contest (the “Contest”) is a contest of skill. Entrants compete on the basis of skill in playing the Ella Run game. There is no drawing and no element of luck in determining a winner.

1. Sponsor

Sniff & Shift LLC, PO Box 126, Devault, Pennsylvania 19432, United States (“Sponsor”). Contact for this Contest and for any request about your personal information: support@sniffandshift.com or (267) 883-4431. This is the same address published in Sponsor’s Privacy Policy and on its Contact Information page.

2. Eligibility

Open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees, officers and directors of Sponsor, and their immediate family members and households, are not eligible. Void where prohibited or restricted by law. Entrants are responsible for complying with any applicable local law. The Ella Run game is free for anyone to play; only the Leaderboard, and the prize attached to it, are limited to entrants 18 years of age or older. If Sponsor learns that an Entrant is under 18, Sponsor will remove that Entrant’s Leaderboard record, unsubscribe the email address from marketing and stop disclosing it to business or marketing partners.

3. Agreement to Rules

By joining the Leaderboard you accept these Official Rules and Sponsor’s Privacy Policy, and you accept Sponsor’s decisions, which are final and binding in all matters relating to the conduct of the Contest, including scoring, verification, tie-breaking, driver names and disqualification. This does not apply to requests about your personal information, which are handled under the Privacy Policy and Section 16 below.

4. Contest Period

The Contest runs in consecutive Monthly Contest Periods until Sponsor ends it. Each Monthly Contest Period begins at 12:00:00 a.m. Eastern Time on the first calendar day of the month and ends at 11:59:59 p.m. Eastern Time on the last calendar day of that month. The Leaderboard resets at the start of each Monthly Contest Period. Only scores achieved during a Monthly Contest Period count toward that period’s Leaderboard. Sponsor’s server clock is the official timekeeper.

5. How to Enter

The Ella Run game is free to play and requires no entry, no account and no purchase. To have your scores appear on the Leaderboard and to be eligible for a prize, you must join the Leaderboard by providing a driver name and an email address, confirming that you are 18 or older, accepting these Official Rules, and subscribing to Sniff & Shift marketing email. If you would rather not subscribe, use the free alternative method of entry below. On the Leaderboard join form the age confirmation comes first: before the driver name and email fields are shown, you are asked for the month and year of your birth. That date is checked in your browser, is never sent to Sponsor and is never stored; only the yes-or-no result is kept, on your own device and as a yes-or-no field on your Leaderboard record. If the result is that you are under 18, the driver name and email fields are not shown and no Leaderboard record is created. The Leaderboard does not ask for a telephone number or a postal address, and joining it does not subscribe you to marketing by text message or postal mail. You may play as many times as you wish during a Monthly Contest Period at no cost. Your best qualifying score in that period is the score that counts.

Free alternative method of entry. To join the Leaderboard without subscribing to Sniff & Shift marketing email, send an email to support@sniffandshift.com with your desired driver name and a statement that you are 18 years of age or older, a legal resident of the fifty (50) United States or the District of Columbia, and that you accept these Official Rules. Sponsor will not enrol anyone who does not confirm all three, and does not ask for or keep a date of birth. Sponsor will enrol you within three (3) business days and reply with instructions for linking your device to the Leaderboard. Entrants who join this way have identical eligibility, identical standing and identical prize rights, and are subject to the same entry limit below. No purchase, payment or marketing subscription is required by either route. An email address given through this route is not added to the Sniff & Shift marketing list. It is still handled under Sponsor’s Privacy Policy, including the disclosures to business and marketing partners described in Section 16; you can opt out of those at any time on Sponsor’s Your Privacy Choices page, linked from the Privacy Policy.

Limit one Leaderboard entry per person and per email address. Using multiple identities, automated play, or any means of submitting a score not produced by genuinely playing the game is grounds for disqualification.

6. How the Winner Is Determined

The Champion for each Monthly Contest Period is the Entrant with the highest verified score achieved during that period. Score is earned automatically at 0.03 points per pixel of distance travelled, plus the point value of each treat collected. There is no random element in scoring and no drawing of any kind. Sponsor verifies scores automatically and may hold any score for manual review before it appears on the Leaderboard or qualifies for a prize. Any score held for review will be resolved within seven (7) days of being posted, and in any event before the end of the Monthly Contest Period in which it was posted. Review criteria are applied on the same basis to every Entrant.

7. Tie-Breaker

In the event of a tie, the tied Entrant whose qualifying score was first recorded by Sponsor’s servers (earliest timestamp) will be the Champion.

8. Prize

One (1) prize per Monthly Contest Period: a ten U.S. dollar ($10.00) Sniff & Shift gift card. Approximate Retail Value (ARV): $10.00 USD. Maximum total prize value awarded to any one person in a calendar year: $10.00 USD. Maximum total prize value awarded in a calendar year: $120.00 USD. The gift card is redeemable at sniffandshift.com, does not expire, has no cash value, and is not transferable or replaceable if lost. No substitution or transfer of prize is permitted except by Sponsor, which may substitute a prize of equal or greater value.

9. One Prize Per Person Per Calendar Year

LIMIT ONE (1) PRIZE PER PERSON PER CALENDAR YEAR. The prize for each Monthly Contest Period is awarded to the highest-ranked eligible Entrant on the final Leaderboard for that period who has not already received a prize during the current calendar year. If the Entrant who finishes in first place has already received a prize during the current calendar year, the prize passes to the next-highest-ranked Entrant who has not, and so on down the Leaderboard. No Entrant receives more than one prize in the same calendar year.

If every Entrant on the final Leaderboard for a Monthly Contest Period has already received a prize during the current calendar year, or if no Entrant posted a qualifying score during that period, no prize is awarded for that period and it is not carried forward.

10. Winner Notification and Delivery

The winner for each Monthly Contest Period is determined automatically within twenty-four (24) hours after that period ends, and the gift card is issued and sent by email at the same time, to the address on the Entrant’s Leaderboard record. No claim step is required and there is nothing an Entrant must do to receive a prize.

It is the Entrant’s responsibility to keep that address current and able to receive email from Sponsor. If the email cannot be delivered, the gift card is still issued: the winner can retrieve the code from the Leaderboard on the device they joined from, or by emailing support@sniffandshift.com. Gift cards issued under these Rules do not expire and are not forfeited for non-use.

11. Taxes

All taxes on a prize are the sole responsibility of the winner.

12. Driver Names

Your driver name is displayed publicly. Do not use your full legal name, your address, a phone number, an email address, a link, or anything you would not want shown on a public page. Sponsor may reject, change or remove any driver name at its sole discretion, at any time and without notice, including names that are obscene, hateful, sexual, harassing, impersonating, misleading or commercial. Removing or changing a name does not affect the score attached to it.

13. Disqualification

Sponsor may disqualify any Entrant and void any score it believes was obtained by tampering with the game, automating play, submitting scores by any means other than genuine play, using multiple identities, or otherwise acting in bad faith. Sponsor’s decisions on all such matters are final and binding.

14. Publicity

Except where prohibited, joining the Leaderboard constitutes permission for Sponsor to display your driver name and score on the Leaderboard and, if you win, in the Hall of Fame and in related announcements, without further compensation. Sponsor will not publish your legal name, your email address or your likeness. You may withdraw this permission at any time by emailing support@sniffandshift.com; withdrawal does not affect the score attached to your driver name or your right to a prize.

15. Limitation of Liability and Release

By entering, you release Sponsor and its affiliates, and their officers, employees and agents, from any liability for any loss, harm, damage, cost or expense arising out of participation in the Contest or acceptance or use of a prize. Sponsor is not responsible for entries or scores that are lost, late, misdirected, incomplete, or not recorded because of technical failure, network problems or any error outside Sponsor’s reasonable control.

This release does not apply to, and Sponsor does not exclude liability for, death or personal injury, fraud or fraudulent misrepresentation, gross negligence, or wilful misconduct. Nothing in these Rules limits any liability or affects any right that cannot be limited or waived under applicable law, including any right you have under the consumer protection laws of your state.

16. Privacy

To operate the Leaderboard, Sponsor records your email address, the driver name you choose, your scores and the duration of your runs, the results of the automatic score checks described in Section 6, and a one-way salted hash of the IP address used to submit scores, which is used to detect duplicate and automated entries. Your scores are never stored alongside your raw IP address. When you join, Sponsor also records the date and time you consented, the version of the text you agreed to, and, if you joined on the Leaderboard page, the IP address you joined from; that consent record exists so Sponsor can show what you agreed to, and it is deleted with your Leaderboard record. Sponsor also counts requests from a one-way salted hash of your IP address, for up to twenty-four (24) hours, to limit how often one connection can call its servers; the address itself is not stored for this purpose. Your browser stores an identifier on the device you joined from, which is what lets you retrieve a gift card code on that device under Section 10.

Information you provide is used to operate the Leaderboard, to send the marketing email you consented to, and to deliver a prize if you win. Sponsor also discloses information such as your email address to business and marketing partners for advertising and marketing, which several state privacy laws treat as a “sale” or “sharing” of personal information. You may opt out at any time, at no cost, on Sponsor’s Your Privacy Choices page, linked from the Privacy Policy, or by sending a Global Privacy Control signal from your browser, which Sponsor honours. Opting out is separate from unsubscribing from marketing email; it does not remove you from the Leaderboard and does not affect your eligibility, your standing or your right to a prize.

All of the above is handled under Sponsor’s Privacy Policy. Leaderboard data is processed and stored by Cloudflare, Inc. on Sponsor’s behalf, and customer and email records are handled by Shopify Inc. You can unsubscribe from marketing email at any time using the link in any email. Unsubscribing does not remove you from the Leaderboard and does not stop Contest email that is not marketing, including the email that delivers a gift card if you win. To delete your Leaderboard record, use the “Remove me” link on the Leaderboard or email support@sniffandshift.com. Deleting your Leaderboard record does not by itself unsubscribe you from marketing email or delete your Sniff & Shift customer record; ask for those in the same message and Sponsor will action them.

Those two controls are shortcuts, not the limit of your rights. Sponsor’s Privacy Policy also describes your rights to confirm and access the information Sponsor holds about you, to correct it, to delete it, to receive a portable copy, to restrict how it is processed, to withdraw a consent you previously gave, to opt out of the sale or sharing of your information, and to appeal a decision Sponsor makes on any such request, together with the ways to exercise each of them. A request may be sent to that address or to the contact details published in the Privacy Policy; either route reaches Sponsor. A request to delete your personal information is treated as covering your Leaderboard record held by Cloudflare as well as your customer and marketing records held by Shopify, unless you ask Sponsor to delete only one of them or Sponsor is required to keep particular records as described below.

Parents and guardians. If you believe a child has joined the Leaderboard, write to the address above. Sponsor will delete the Leaderboard record and its scores, remove the email address from Sponsor’s marketing list, stop disclosing it to business or marketing partners, and confirm in writing. Sponsor does not ask for the child’s date of birth or for proof of age.

The twenty-four (24) month period in this paragraph applies to the Leaderboard record Sponsor holds with Cloudflare. Leaderboard records are kept while the Contest runs and for twenty-four (24) months after an Entrant’s last activity, after which they are deleted. Your customer and marketing records held by Shopify are kept for the periods described in the Privacy Policy, and deleting your Leaderboard record does not by itself delete those. Records needed to identify a gift card that has been issued but not yet redeemed are kept until it is redeemed. Records of prizes actually awarded are kept for as long as required for tax and accounting purposes, with the Entrant’s personal details removed once they are no longer needed. If you delete your Leaderboard record, the Hall of Fame entry for any month you won keeps the month and the winning score but no longer shows your driver name.

If you disagree with a decision about your information. If Sponsor refuses a request you make about your personal information, or grants it only in part, Sponsor will tell you why. You may appeal by replying to that answer, or by emailing support@sniffandshift.com with APPEAL in the subject line, and Sponsor will respond within forty-five (45) days. If you are still not satisfied you may contact the Office of Attorney General of your state of residence; California residents may also contact the California Privacy Protection Agency. This route concerns your personal information only. It does not reopen a scoring, verification, driver name or disqualification decision under Sections 6, 12 or 13.

17. Modification and Termination

If the Contest cannot run as planned because of technical failure, tampering, or any other cause beyond Sponsor’s reasonable control that corrupts the administration, security or fairness of the Contest, Sponsor may suspend, modify or end the Contest. If the Contest is ended early, any prize for a completed Monthly Contest Period will still be awarded according to these Rules.

18. Governing Law and Disputes

These Rules are governed by the laws of the Commonwealth of Pennsylvania without regard to its conflict-of-laws provisions. Any dispute will be resolved in the Court of Common Pleas of Chester County, Pennsylvania, or in the United States District Court for the Eastern District of Pennsylvania, and each Entrant consents to the jurisdiction of, and venue in, those courts. Any claim is to be resolved individually, and not as part of a class or representative proceeding, to the extent permitted by applicable law. Nothing in this Section limits any right you have under a privacy law, including the rights to access, delete, correct, opt out of sale or sharing, appeal and complain to a regulator described in Sponsor’s Privacy Policy, or your ability to contact a state attorney general.

19. Severability

If any provision of these Rules is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Sponsor’s failure to enforce any provision is not a waiver of it.

20. Winners List

Past Champions are listed in the Hall of Fame on the Leaderboard. For a written list of winners, email support@sniffandshift.com.

21. Trophies, Achievements and Streaks

The Leaderboard shows two decorative marks beside a driver name. The first is a trophy, labelled Champion, shown once for each Monthly Contest Period in which that Entrant received a prize. The second is the single highest achievement that Entrant has unlocked; achievements unlock automatically from what happens in a run, such as reaching a given score in a single run or posting your first run. Both marks are ornamental. They have no cash value, they are not a prize under these Rules, they cannot be bought, sold, given or traded, and Sponsor may add, rename, alter or withdraw any of them at any time. They are displayed beside your driver name as part of the Leaderboard, under the permission in Section 14.

The marks do not affect who wins. The Champion for each Monthly Contest Period is the Entrant with the highest verified score achieved during that period, determined under Sections 6 and 7, and a prize is awarded under Sections 8 and 9. No trophy, achievement or streak changes an Entrant’s score, rank, eligibility, or position in the order in which a prize passes down the Leaderboard, and holding none of them costs an Entrant nothing. A mark plays no part in the decision, so there is nothing an Entrant can do with one to finish any higher.

Your streak is private. Sponsor counts the consecutive Eastern Time calendar days on which you posted at least one score that Sponsor accepted, together with the longest such run of days you have recorded. That count is shown to you alone, on the device you joined from, through the identifier described in Section 16. It is not shown on the Leaderboard, is not published to search engines, is not part of anything Sponsor publishes or that you can share, and is not shown to other Entrants. It is worked out from the scores and run durations already described in Section 16 and records nothing further about you, and it goes when your Leaderboard record goes.

22. The Garage

Playing the Ella Run game earns points. Points accumulate automatically from the scores you post and can be exchanged, inside the game only, for alternative cars and dogs to play as. What you exchange points for is decoration and nothing else. Every car and every dog in the Garage behaves identically: the same speed, the same handling, the same scoring. None of them travels further, collects more treats, or earns a single point more than the Camaro and Ella that every Entrant starts with and that remain free to everybody. There is nothing in the Garage to buy, because there is nothing in the Garage that money can reach: points are earned by playing and by no other means.

Nothing in the Garage affects who wins. The Champion for each Monthly Contest Period is the Entrant with the highest verified score achieved during that period, determined under Sections 6 and 7, and a prize is awarded under Sections 8 and 9. Your points balance, the cars and dogs you have unlocked, and the ones you choose to play as change no part of that. They do not change your score, your rank, your eligibility, your position in the order in which a prize passes down the Leaderboard, or anything else Sponsor considers in deciding a Contest. An Entrant who never unlocks anything and plays as Ella in the Camaro all year is at no disadvantage of any kind, and an Entrant who unlocks everything gains no advantage of any kind. Sponsor may add, rename, alter or withdraw any item in the Garage at any time.

Points have no cash value and are not transferable. They are not money, not a prize under these Rules, not a credit toward a purchase, and not redeemable for cash, goods, services, gift cards or anything else outside the game. They cannot be bought, sold, given, traded, combined with another Entrant’s points, or moved to another person or account, and they have no value of any kind outside the Ella Run game. Your points balance is shown to you alone and is not published on the Leaderboard. Your points and everything you have unlocked are lost when your Leaderboard record is deleted, whether you delete it yourself or Sponsor removes it under Section 13, and Sponsor may end the Garage at any time under Section 17 without owing any compensation for a balance or for anything unlocked.
